Hit and Run Accident Lawyers

According to the American Automobile Association’s (AAA) Foundation for Traffic Safety, there are, on average, 682,000 hit and run accidents every year in the United States. In 2015, that number was 737,100 – about one hit-and-run crash every 43 seconds.

Five percent of hit and run accidents result in a fatality, and that number is not going down. The 2,049 deaths from hit and run crashes in 2016 is the highest number on record. The majority of those killed were pedestrians or bicyclists.

Have You Been the Victim of a Hit and Run Accident?

Have you been hit or lost a loved one in a hit and run accident? Whether hit as a pedestrian, cyclist or another motorist, there are actions you can take to receive maximum recovery for your damages.

If the at-fault driver does not stop to exchange information, or long enough to record the license plate number, you may be wondering what recourse you have, if any. An experienced personal injury attorney can help you determine if legal action can maximize your chance for financial recovery.

Why Drivers Flee the Scene

A 2012 study analyzed data on hit and run crashes between 1998-2007 to identify factors related to the identification of the fleeing driver. The study found that hit and run drivers are more likely to be young males with a history of Driving Under the Influence (DUI) charges and/or license suspension. They often have a high blood alcohol content (BAC) at the time of their arrest.

Also, they tend to drive older model cars, suggesting a lower socioeconomic status.

Finding a Hit and Run Driver

According to the AAA report, about half of all hit and run drivers are eventually caught.

Witnesses to the accident can provide information that aids in finding the driver. Video is another helpful source of information. With the plethora of surveillance, security, mobile phone and other video cameras, there is often video footage available showing your accident. There may be evidence left at the scene that can identify the car.

Because memory fades over time and video may be deleted after a given period, it is important to seek an attorney without delay to secure evidence before it is gone.

Compensation When Responsible Party Cannot Be Found

If you have Uninsured Motorist (UM) coverage on your automobile insurance policy, you have the right to seek compensation for a hit and run accident. If you don’t have UM coverage, we strongly urge you to add it onto your policy.

However, if you have been seriously injured or a loved one was killed in a hit and run accident, you should contact a personal injury attorney as soon as possible, regardless of whether you have uninsured motorist coverage. Their experience investigating such accidents and dealing with insurance companies will help ensure you receive the maximum amount of compensation available. For example, there may be factors that contributed to the accident, such as an improperly working traffic signal or obstructed signage, in which case, you may be able to seek compensation from the entity responsible for maintaining the roads and signage.

What to do If You Have Been in a Hit-and-Run Accident

Seek Medical Attention

If you’re injured by a hit and run driver, first, seek emergency medical attention.

Record Accident Facts

As soon as you can safely do so, you should:

  • Write down the date, time, and location of the accident.
  • Write down a description of the vehicle: the color, body style, number of doors, approximate age, etc.
  • Write down the license plate number, if you saw it, or a portion of it.
  • Talk to any eye witnesses to the collision, and record their full legal names and telephone numbers.
  • File a report with the police and Department of Motor Vehicles.

Do Not Speak to Insurance Providers until You Have Retained an Attorney

If you have been seriously injured or a loved one killed by a hit and run driver, do not talk with an insurance company investigator or adjuster before you have had the chance to retain an attorney. In your emotional state, you may say something that will be used as an excuse to reduce your claim.
