Car accidents in San Diego: what to know

The City of San Diego recorded 115 traffic deaths in 2024, according to state crash data reported by KPBS. Many of the cases we see start on the I-5, I-8, I-15, I-805 and SR-163, and in busy areas with visitors, rideshare pickups and people on foot.

California rules that shape your case

  • Partly at fault? You can still recover. California uses pure comparative fault. Your compensation is reduced by your share of the blame, but it is not taken away.
  • Insurance limits are low. California's minimum liability coverage is $30,000 per person and $60,000 per crash for injuries (since January 1, 2025). Your own underinsured motorist coverage can add to a small policy.
  • Driving without insurance limits your recovery. An uninsured driver generally cannot recover pain and suffering, even when the other driver is at fault. There are exceptions, for example when the other driver is convicted of DUI.
  • Deadlines vary. How long you have depends on the type of case and who is responsible. Claims against a government agency, such as a city vehicle or a dangerous public road, can have deadlines measured in months. Call early, and we find the deadline that applies to you.

Most San Diego injury lawsuits are filed in San Diego County Superior Court. Most cases settle before trial. When an insurer will not pay fairly, we are ready to try the case.
