UPS and delivery truck accidents: what to know
Package delivery trucks are on every street, many times a day. Drivers work under tight schedules, make frequent stops, back up in tight spaces and double-park. Crashes with delivery trucks can injure other drivers, cyclists and people on foot.
Who can be responsible
- The delivery company. When the driver is an employee on the job, the company is generally responsible for the driver's carelessness. It can also be responsible for its own choices, such as training, schedules and vehicle maintenance.
- A contractor or vehicle owner, if the driver worked for a separate company.
- A maintenance or parts company, for brake, tire or other failures.
Large delivery companies have their own claims departments and lawyers. Their first goal is to limit what they pay.
Federal safety rules can apply
Larger commercial trucks used in interstate commerce must follow federal safety rules on driver hours, inspections and maintenance (FMCSA). Whether a rule applies depends on the vehicle and the trip.
The evidence
Delivery trucks often carry cameras and tracking systems that record speed, location, braking and stops. The company also keeps the driver's route, training and accident history. This evidence can be overwritten. A lawyer should send a preservation letter right away.
