Liability For San Diego Pedestrian Accidents

San Diego has one of the highest instances of pedestrian collisions across California. According to the San Diego City Government, “On average, 1,000 pedestrians and bicyclists are hit and seriously injured each year in San Diego. Residents living in neighborhoods where more people walk – Downtown, Southeastern and City Heights – are hardest hit. They are 10x more likely to be hit by a car.” There are a number of factors that could potentially contribute to a pedestrian collision.

  • Speeding
  • Distracted driving
  • Poor road conditions
  • Driver fatigue

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. In particular, drivers should slow down at night when pedestrians are less visible. Pursuant to California Vehicle Code 21950, the driver of a vehicle facing a pedestrian shall reduce their speed and take any other action necessary to safeguard the safety of any pedestrian in the roadway.

Many pickup trucks are used for commercial purposes. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

Many victims of pedestrian accidents may not realize the full extent of their injuries for several weeks or months after a collision. It is common for people injured in car accidents to suffer long-term psychological trauma in the form of PTSD. Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
