Liability In Santa Barbara County Semi-Truck Accidents

Semi-trucks are essential for the economy. They carry up to 80% of all of the goods that are sold in the United States. But they are particularly dangerous for a number of reasons. A fully loaded semi-truck can weigh as much as 80,000 lbs. It can take the length of two football fields for a commercial truck at freeway speeds to come to a stop. There are a number of measures that truck drivers should take in order to prevent accidents.

  • Truck drivers should be well rested before the start of their shift.
  • Truck drivers should take periodic breaks during their working hours.
  • Truck drivers should check their blind spots before making turns or lane changes.

Truck drivers must get a commercial driver’s license (CDL) and are held to a high standard in terms of safety. Many truck accidents occur when truck drivers make dangerous lane changes.  Pursuant to California Vehicle Code 22107, no person shall turn a vehicle from a direct course left or right upon a roadway unless such a movement can be made with reasonable safety after giving an appropriate signal. Commercial trucks have large blind spots and often overlook small vehicles and motorcyclists.

If a truck driver was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, employers are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, truck companies will try to evade liability for collisions by hiring truck drivers as “independent contractors.” Victims of semi-truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured in a truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. California has a comparative fault law. Even if a person is partially responsible for an accident, they still may have recourse through an injury claim. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
