Liability In Sacramento County Boat Accidents

Thousands of people are seriously injured in boating accidents every year. According to the American Boating Association, “In 2020, the Coast Guard counted 5,265 accidents that involved 767 deaths, 3,191 injuries and approximately $62.5 million dollars of damage to property as a result of recreational boating accidents.” There are a variety of factors that could potentially contribute to a boat accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication

All boat operators must learn waterway rules and exercise due care in order to avoid causing accidents. There are speed limits that apply to waterways in California in much the same way that there are speed limits on the road. Any driver that is within 100 feet of a person in the water must reduce their speed to 5 mph. If a boat operator hits someone in the water, they could be held at fault through a negligence claim. Victims of boat accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Spinal cord injuries

Any person that is injured in a boat accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, boat operators will often fight hard to deny responsibility for an accident. A boat accident attorney can examine all of the facts of your case and let you know what your legal options are.
