The pedestrian became entangled underneath the sedan following the collision. Paramedics were called to the scene of the collision in order to help the victim.

Firefighters were able to extricate the pedestrian from underneath the car. Sadly, the male pedestrian died as a result of his injuries. A full investigation in the collision on Highway 273 remains ongoing at this time.

Liability In Redding Pedestrian Accidents

Thousands of people are killed or seriously injured every year in pedestrian collisions. According to the NHTSA, “Unfortunately, pedestrian injuries and fatalities remain high. In 2020, 6,516 pedestrians were killed and an estimated 55,000 pedestrians were injured nationwide.” There are a number of factors that could potentially contribute to a pedestrian collision.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. A large number of pedestrian collisions are due to drivers traveling too fast for the prevailing conditions. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” There are many steps that should be taken after any accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • A thorough investigation should be conducted.

When a driver is negligent and kills a pedestrian, they can be held to account through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that come with the sudden loss of a loved one. Sadly, though, it is common for drivers to deny liability for collisions even when they are at fault. This is why it is so crucial that all evidence is preserved after any crash.
