Sacramento County police officials are saying that the accident took place on Tuesday morning. Paul O’Hara was riding a motorcycle when he was involved in a collision with a car.

The motorcyclist was ejected and landed in the slow lane of the freeway. Paul O’Hara was then hit by a semi-truck causing him to sustain major injuries.

Paramedics were called to the scene in order to help him. But he was beyond medical aid and died at the scene.

The driver of the semi-truck remained at the scene and cooperated with police.

Liability In Sacramento Semi-Truck Accidents

Motorcyclists are extremely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to Injury Facts, motorcyclists make up only around 3% of all drivers. But they account for around 14% of all traffic fatalities. In 2019 alone, around 5,000 motorcyclists were killed in collisions. There are a number of steps that drivers should take in order to reduce the odds of colliding with a motorcyclist.

  • Drivers should maintain a safe distance from motorcyclists.
  • Drivers should use turning signals to let others know of their intentions.
  • Drivers should check their blind spots to avoid inadvertently colliding with motorcyclists.

There could be numerous liable parties for any motorcycle accident. Many collisions are due to drivers that make dangerous lane changes and hit motorcyclists. According to California Vehicle Code 22107, no driver shall turn a vehicle to the left or right on a roadway unless such a movement can be made with reasonable safety. If a driver suddenly turns into the path of another vehicle prior to a collision, they will typically be held at fault.

A truck driver could also be held responsible for a crash. Truck drivers have a duty to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall exercise due care in order to avoid hitting a pedestrian. They must exercise due care, reduce their speed and take other actions related to the operation of their vehicle as necessary to safeguard the wellbeing of the pedestrian.

If a truck driver was working at the time of a collision, the company that they were working for could be held at fault. In general, employers are liable for the negligent actions of their employees – insofar as the employees were working within the course and scope of their employment. A company could also be liable for failing to ensure that their driver had the right license and qualifications to operate their vehicle. There are a number of steps that should be taken after any truck accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • A truck’s event data recorder (EDR) should be examined.

The family of any victim that died in a truck accident may have legal recourse through a wrongful death claim. A wrongful death claim can help cover many of the expenses commonly associated with the tragic loss of a loved one. Damages can help cover lost wages, medical bills and loss of love. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
