Liability For Sacramento County Car Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the NHTSA, in 2020 alone 6,516 pedestrians were killed in car accidents. Another 55,000 pedestrians were injured and required hospitalization. There are a number of steps that driver should take in order to avoid hitting pedestrians.

  • Drivers should continuously scan the road ahead of them.
  • Drivers should slow down during periods of inclement weather.
  • Drivers should be well rested before heading out onto the road.

A large number of pedestrian accidents are due to drivers that are speeding. Pursuant to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Lacerations
  • Organ damage
  • PTSD

The family of any person that is killed due to the negligence of another driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, it is common for drivers to deny all liability for a collision. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
