Liability In San Joaquin County Semi-Truck Accidents

Semi-trucks are involved in thousands of fatal truck collisions every year. While no two accidents are identical to one another, these collisions often share many of the same causes. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur. ” There are many steps that truck companies should take in order to prevent truck accidents.

  • Truck drivers should be properly licensed and well-trained.
  • Trucks can be equipped with safety features such as forward collision avoidance systems.
  • Truck drivers should receive periodic medical exams to ensure that they are fit to drive.

All truck drivers have a legal obligation to exercise due care in order to avoid collisions. A large number of truck accidents are due to drivers that are speeding. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. Trucks are difficult to control and their drivers are far more likely to crash when they disregard speed limits.

The company that a truck driver worked for could potentially be liable for a collision. Companies are typically liable for the wrongful actions of their employees – insofar of those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they were involved in a crash. However, not every truck driver is an employee. Many companies hire truck drivers as independent contractors to evade liability for collisions. There are a number of steps that should be taken after any truck accident.

  • The employment status of the truck driver should be determined.
  • The truck’s event data recorder (EDR) should be examined.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.

The family of any person that died in a truck accident may have legal recourse through a wrongful death claim. Any person that is injured in a truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. However, truck companies will often do everything in their power to deny liability for truck accidents. This is why it is so important that all evidence is properly preserved after any collision.
