NORTH HIGHLANDS, CALIFORNIA (December 27, 2022) – A 22-year-old woman identified as Destiny Abdrazack died after an electrical short caused a Christmas Eve home fire.

Sacramento County officials are saying that the incident took place on Christmas Eve. Destiny Abdrazack was staying with her fiancé’s family at a home on David Drive in North Highlands.

Around 2:00 a.m. an artificial Christmas tree short circuited and this lead to a fire. Destiny Abdrazack was the one that yelled fire thereby alerting other people in the house to the danger.

Within just a matter of minutes the entire North Highlands home was ablaze. Firefighters and paramedics were called to the scene to help all of the victims and put out the fire.

Sadly, Destiny Abdrazack and two family dogs died due to their injuries. You can help support the family of the victim through GoFundMe.

According to the GoFundMe page, “Destiny is one of the most beautiful souls that crossed our paths. She is no longer earth side but she will always be with us. Any donation at this time helps. All donations and funds will go to Destiny’s parents and her siblings for hospital and funeral costs.”

Liability For North Highlands Electrical Fires

Thousands of people are seriously injured or killed every year in home fires. According to the National Fire Protection Association, “On average, a fire department responded to a fire somewhere in the US every 23 seconds in 2020. A home structure fire was reported every 89 seconds, a home fire death occurred every three hours and 24 minutes, and a home fire injury occurred every 46 minutes.” There are a number of factors that could potentially contribute to a home fire.

  • A fire may start due to an electrical malfunction.
  • A fire may start due to malfunctioning appliances.
  • A fire may start due to the ignition of natural gas.

Depending on the facts of any case, the company that manufactured a home good like a Christmas tree could potentially be liable for a home fire. Companies that manufacture products have a legal responsibility to ensure that those products are reasonably safe. When a household product is unreasonably dangerous, this could form the basis of a negligence claim. Most product liability claims alleging negligence will be based on one of the following theories of liability.

  • Design Defects: Design defects are inherent to a product and exist before the product is manufactured.
  • Manufacturing Defects: A manufacturing defect occurs during the construction or creation of a product.
  • Marketing Defects: A product may have a marketing defect when a company fails to warn about the non-obvious dangers associated with the use of their product.

A number of lawsuits have been filed against Walmart and the manufacturers of electric hoverboards. One of the issues with these hoverboards is that the lithium ion batteries that they use often become unstable. A number of home fires have been started after their batteries short circuited. It is common for companies to cut corners in terms of safety to make their products more profitable. In many situations, this can lead to devastating results. There are a number of steps that should be taken after any home fire caused by a consumer product.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A forensic analysis of the home fire may need to be conducted.

The family of any person that died in a home fire caused by a consumer product may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, it is extremely common for large corporations to deny all responsibility when their products cause home fires and death. This is one of the reasons that it is so important that all evidence is properly preserved after any fire. Evidence is what will ultimately be needed to demonstrate liability for any fire.
