Liability In Rocklin Car Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year. According to data from the NHTSA, California has one of the highest instances of pedestrian fatalities at 972 in 2019. It also has the 8th highest pedestrian fatality rate per capita. Dense population centers like Los Angeles, San Diego and the Bay Area tend to have the most accidents within the states. There are a number of steps that can be taken in order to avoid pedestrian collisions.

  • All drivers should reduce their speed when pedestrians are nearby.
  • Cities should help ensure that pedestrian crosswalks are well illuminated.
  • City official should study intersections and roads with a history of pedestrian collisions.
  • Pedestrians should wear reflective clothing when possible.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall yield the right of way to a pedestrian crossing the roadway in any marked or unmarked crosswalk. If a driver does not yield the right of way to a pedestrian and hits them, they could face civil liability for the accident. Depending on the facts of any case, liability for a collision could extend beyond any driver.

If the driver that killed a pedestrian was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a driver may have been on their way to deliver packages for a customer.

A city could also potentially be liable for an accident if it was caused by a dangerous condition with a roadway. According to California Government Code 835.2, a public entity may be liable for an accident caused by a dangerous condition on their property. However, the public entity must have had actual or constructive notice of the dangerous condition prior to the accident. There are a number of ways that a roadway or intersection could be in a dangerous condition.

  • An intersection may lack appropriate traffic control devices or signs.
  • An intersection may have foliage that blocks a driver’s line of sight.
  • An intersection may have potholes that cause drivers to lose control of their vehicle.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. Sadly, though, companies and cities will fight hard to deny liability for any accident. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
