Liability For San Jacinto Scooter Accidents

Scooter accidents have become increasingly common with the rise of companies like Lime and Bird. According to the United States Consumer Product Safety Commission, “There were more than 190,000 emergency room (ED) visits due to all micromobility products from 2017 through 2020. ED visits had a steady 70% increase from 34,000 (2017), 44,000 (2018), 54,800 (2019) to 57,800 (2020).” There are a number of factors that could contribute to a scooter accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Drunk driving

All drivers have a legal obligation to exercise due care to avoid hitting pedestrians and scooter riders. This is true even if scooter riders are in the middle of the roadway. If a driver fails to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. The family of any person that died in a scooter accident may be able to seek some measure of justice through a wrongful death claim.
