Liability For Perris Semi-Truck Accidents

Motorcyclists continue to be overrepresented in fatal collisions every year. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 18% of all occupant fatalities, and 4% of all occupant injuries in 2020.” There are a number of steps that drivers should take in order to avoid hitting motorcyclists.

  • Drivers should check their blind spots before making turns.
  • Drivers should continuously scan the road ahead of them.
  • Drivers should abstain from alcohol and other intoxicating substances.

Semi-truck drivers will need to get a commercial driver’s license (CDL). As commercial drivers, they are held to a high standard in terms of safety. They must do everything that human care and vigilance can do in order to prevent collisions. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left must first yield the right of way to any driver that is close enough so as to pose a hazard. If a truck driver makes an abrupt turn in front of a motorcyclist, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured in a truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is common for truck companies to deny liability for any accident involving their driver. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
