Liability For Jacksonville Pedestrian Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the Texas Department of Transportation, “In 2021, there were 5,366 crashes involving pedestrians in our state, resulting in 841 deaths, a 15% increase in pedestrian fatalities over the previous year. Another 1,470 people were seriously injured.” There are a number of steps that drivers should take in order to prevent pedestrian collisions.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should continuously scan the road ahead of them for hazards.
  • Drivers should be well-rested before they head out onto the road.

All drivers must exercise due care to avoid hitting pedestrians in the roadway. This is true even if the pedestrian was in the middle of the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claims. It is common for drivers to be distracted, speeding or fatigued prior to hitting a pedestrian. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

If the driver of a pickup truck was working at the time of a collision, it is possible that their employer could face vicarious liability for the crash. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Potential beneficiaries in a civil claim will typically include the victim’s spouse or children. It is extremely important that all evidence is properly preserved after any collision.
