Liability For Harlingen Semi-Truck Accidents

Semi-trucks are much more difficult to safely maneuver than passenger vehicles. A truck driver is not only responsible for safely controlling the cab of the truck but the trailer as well. To that end, truck drivers will need to get a commercial license and undergo specialized training in order to drive safely. There are a number of factors that could lead to a semi-truck jackknifing in the roadway.

  • Trucks are more likely to jackknife on roads slick with rain or snow.
  • Trucks are more likely to jackknife when a truck driver is speeding.
  • Semi-trucks can weigh as much as 80,000 lbs. They often jackknife when a truck driver fails to brake properly.
  • Improperly secured cargo can also lead a semi-truck to jackknife.

Jackknife collisions are often highly preventable and due to truck drivers that were not exercising due care. Pursuant to Texas Transportation Code Section 545.351, no person shall operate a motor vehicle at a speed greater than what would be reasonable given the prevailing conditions of the roadway. If a truck driver fails to slow down to prevent their vehicle from jackknifing, this could form the basis of a negligence claim.

When a truck driver is negligent and causes an accident, their employer could potentially be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they crashed. There are numerous steps that should be taken after a semi-truck accident.

  • Surveillance footage of the crash should be reviewed.
  • The truck’s event data recorder (EDR) should be examined.
  • The truck driver’s logbook should be sought.
  • Maintenance records for the semi-truck should be inspected.

Any person that is injured due to the negligent actions of a truck driver may have legal recourse through a bodily injury claim. The family of any person that is killed in a truck accident may have recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
