The investigation must establish a legal basis for each claim. A driver may have failed to yield, turned across a cyclist's path, followed too closely or passed without enough room. A vehicle occupant may have opened a door into the rider's path. Evidence can also point to an employer, a defective component or a party responsible for road maintenance. The presence of an injury alone does not establish liability.
The Nevada DMV's traffic-law guidance explains that drivers passing a bicycle must move into an adjacent left lane when it is safe and available. If a lane change is not possible, drivers must allow at least three feet of clearance. Whether a violation contributed to your collision depends on the evidence.
Under NRS 41.141, a rider's own negligence can reduce recovery in a qualifying negligence claim. Recovery is barred if that negligence exceeds the combined negligence of the defendants against whom recovery is sought. An insurer's allegation of fault is a position to investigate, not a final finding.

A bicycle injury claim can involve fractures, spinal trauma, internal injuries and traumatic brain injuries. Medical records should explain both the initial injury and its effects over time. Treatment bills alone may not describe lost mobility, time away from work or the need for future care.
Depending on the facts and applicable law, a claim may seek compensation for medical expenses, lost earnings, reduced earning capacity, pain and suffering, and damage to the bicycle or other property. Future losses need support from appropriate records and, when needed, qualified experts. There is no fixed settlement amount for a bicycle accident.

NRS 11.190(4)(e) generally provides a two-year limitation period for personal injury lawsuits. Accrual rules, exceptions and government-claim procedures can affect the analysis. Ask a lawyer to identify all applicable deadlines promptly; do not assume that every claim or required step follows the same timetable.
