Liability For San Jose Pedestrian Accidents

According to the San Jose Police Department, the city of San Diego has historically had a high percentage of fatal pedestrian collisions. The vast majority of these collisions are preventable and involve some amount of human error. Drivers are supposed to do everything that they can to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle must exercise all due care to avoid hitting any pedestrian in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are many steps that should be taken after any pedestrian collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

If a driver fled the scene of a collision resulting in injury or death, they could face criminal and civil liability for the collision. The family of any person that is killed due to the negligent actions of a driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
