Liability For Emeryville Hit-And-Run Collisions

Driver intoxication is one of the leading causes of car accidents in the United States. According to the NHTSA, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 45 minutes. In 2020, 11,654 people died in alcohol-impaired driving traffic deaths — a 14% increase from 2019.” There are a number of substances besides alcohol that could potentially impair a driver.

  • Cannabis
  • Antidepressants
  • Benzodiazepines
  • Sleep aids
  • Prescriptions

It is illegal for any driver to operate their vehicle under the influence of drugs or alcohol under California Vehicle Code 23152. If an intoxicated pickup truck driver was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person that is injured due to the negligent actions of a drunk driver may be able to seek some measure of justice through a civil claim.
