Liability For Redwood City Inmate Deaths

State prisons are becoming increasingly deadly places. According to the Prison Policy Initiative, “In 2018, state prisons reported 4,135 deaths (not including the 25 people executed in state prisons); this is the highest number on record since BJS began collecting mortality data in 2001.” There are many different causes of inmate death.

  • Inmate on inmate assaults
  • Cancer
  • Heart attacks
  • Overdoses

Inmates have a constitutional right to receive reasonably adequate healthcare. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. For example, correctional officers may not have given an inmate proper care while they were going through an overdose. There are a number of steps that should be taken after any inmate death.

  • Surveillance footage should be sought.
  • Body camera footage from officers involved should be examined.
  • An autopsy should be performed.

It can be difficult to know where to begin after any in-custody death. However, it is important for inmates to know that they do have rights. The family of any person that is killed while in custody may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
