Liability In San Francisco Muni Bus Accidents

San Francisco is heavily populated and can be particularly dangerous for pedestrians. But the danger is not spread out evenly across the city. A large portion of car accidents occur in the Mission District. In response to the growing number of collisions, city officials have sought to implement a policy they’ve dubbed “Vision Zero.” Part of Vision Zero includes studying where accidents take place and implementing solutions to make intersection safer. There are many factors that could influence the likelihood of a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue

Buses are considered “common carriers” under the law and their drivers are held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” The vast majority of bus accidents involve some amount of human error.

All drivers must exercise due care in order to avoid collisions. Many bus accidents are due to bus drivers that fail to check their blind spots and make dangerous left turns. According to California Vehicle Code 21801, any person intending to turn left onto a road or highway must first yield the right of way to any vehicle traveling from the opposite direction close enough so as to pose a hazard. Victims of bus accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

The FMCSA requires buses that can carry 16 or more passengers to have at least $5,000,000 worth of liability coverage. Any person that is injured in a bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
