Liability For Jurupa Valley Dog Attacks

According to one report by the World Animal Foundation, “Hospitals treat 885,000 patients who seek medical care from bites, 370,000 of those need emergency attention, and 16 deaths occur. Children are more vulnerable and receive 70% of all bite-related deaths. Dog bites are mostly preventable through education.” What follows are just a few measures that dog owners can take to help prevent attacks.

  • Dogs should be socialized from an early age to make them less apprehensive around people.
  • Dogs should be properly secured at the home of the owner of the dog.
  • Dogs should always be walked on a leash except in designated off-leash areas.

A dog owner in California is held strictly liable for injuries that their animal causes under California Civil Code 3342. It does not matter whether the owner had prior knowledge of previous attacks or knew about the dog’s vicious nature. The owner is liable for attacks that occur for any person that is bitten when lawfully in a public or private place including the home of the owner of the dog. There is an exception under the statute in the event someone antagonizes a dog before being attacked. Victims of dog attacks tend to suffer very serious and costly injuries including:

  • Lacerations
  • Amputations
  • Infections
  • Death

It can be hard to know where to begin after any dog attack. But it is important for victims of dog attacks to know that they do have rights. The family of any person that is killed in a dog attack may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A dog bite attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
