Liability In Newport Beach Bicycle Accidents

California has one of the highest instances of hit-and-run collisions in the United States. According to Value Penguin, “There were 2,948 fatal hit-and-runs in California from 2010 to 2019, resulting in 3,056 deaths. Both numbers are higher than in any other state. Additionally, there were 8.8 fatal hit-and-runs for every 10 billion miles traveled in California during this period — higher than in all other states but the District of Columbia and Arizona.” There are many factors that could potentially contribute to a hit-and-run collision.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver intoxication

All drivers have a legal obligation to exercise due care to avoid hitting bicyclists and pedestrians. Drivers are supposed to maintain at least three feet of separation from bicyclists as they are passing. Pursuant to California Vehicle Code 22350, the driver of a vehicle shall not operate a vehicle at a speed greater than what would be reasonable given the prevailing conditions of the roadway. If a driver fails to reduce their speed, this could form the basis of a negligence claim.

Drivers that flee the scene of car accidents could also face criminal liability for their actions. It is illegal for any driver to flee the scene of a crash that results in bodily injury or death. Drivers that are involved in an injury collision must remain at the scene and exchange insurance information. There are a number of steps that should be taken after any hit-and-run collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Fragments of the fleeing vehicle should be examined.
  • A thorough, independent investigation should be conducted.

The family of any bicyclist killed in a collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that come with the sudden loss of a loved one. Sadly, though, drivers will often fight extremely hard to deny responsibility for any crash. This is why it is so important that all evidence is properly preserved.
