Liability For Tulare County Garbage Truck Accidents

Garbage truck accidents are much more common than many people realize. According to Motor Biscuit, “Garbage truck crashes can be particularly dangerous, considering their sheer size and weight. Government-run and privately owned garbage, trash, and recycling services must adhere to safety standards to minimize the number of accidents that their trucks cause.” There are a number of factors that make garbage trucks particularly dangerous.

  • Garbage trucks have large blind spots that can obscure the presence of smaller vehicles.
  • Garbage trucks tend to operate in the early morning hours when visibility is reduced.
  • Garbage trucks have a wide turning radius and are more likely to be involved in side impact collisions.

Garbage truck operators must exercise due care to avoid collisions. Private garbage truck companies tend to have a worse safety record than their public counterparts. Many collisions are due to drivers that were rushing to complete their routes. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a garbage truck driver fails to slow down to avoid hitting another vehicle, this could form the basis of a negligence claim .

The company that a garbage truck driver worked for could be held liable for a collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a garbage truck driver may have been completing a route to pick up trash when they crashed. Victims of garbage truck accidents often suffer very serious and costly injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It is common for accident victims to not realize the full extent of their injuries for some time after a collision. Any person that is injured in a garbage truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A garbage truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
