Liability For Fresno County Car Accidents

Rear-end collisions are the most common type of car accident that occur. They are also the most preventable. According to the NHTSA, “Rear-end crashes are the most frequently occurring type of collision, accounting for approximately 29% of all crashes.” The vast majority of rear-end collisions are due to drivers that are speeding or following the lead vehicle too closely. There are many steps that drivers should take to avoid rear-end collisions.

  • Drivers should ensure that their vehicle is properly maintained.
  • Drivers should slow down during periods of inclement weather.
  • Drivers should be well rested before heading out onto the road.

All drivers have a legal obligation to exercise due care to avoid collisions. Pursuant to California Vehicle Code 21703, the driver of a motor vehicle shall not follow another vehicle more closely than would be reasonable or safe given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of traffic. Victims of rear-end collisions tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
