Liability For Diamond Bar Bus Accidents

Thousands of people are injured every year in bus accidents across the United States. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” There are a number of common factors that could contribute to a bus accident.

  • A large number of bus accidents are due to speeding.
  • Buses have large blind spots and many collisions occur when bus drivers make unsafe lane changes.
  • Driver fatigue can be just as dangerous as driver intoxication.

Bus companies are considered “common carriers” and are held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care and foresight reasonably can do to keep their passengers safe.

Many bus accidents are due to speeding. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than would be safe given the prevailing conditions of the roadway. A fully loaded bus can weigh more than 40,000 lbs. They take much longer to come to a stop than passenger vehicles.

If a tour bus driver was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of bus accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The FMCSA requires buses that can carry more than 15 passengers to have at least $5,000,000 worth of liability coverage. Any person that is injured in a bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A Los Angeles bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
