Liability For Bakersfield Pedestrian Accidents

According to the Governors Highway Safety Association (GHSA), “Drivers struck and killed an estimated 7,485 people on foot in 2021 – the most pedestrian deaths in a single year in four decades and an average of 20 deaths every day.” The vast majority of pedestrian accidents are preventable. Drivers should take the following precautions to avoid hitting pedestrians.

  • Drivers should slow down during periods of reduced visibility.
  • Drivers should be well rested before heading onto the road.
  • Drivers should always use their turn signals to let pedestrians and other drivers know of their intentions.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Even if a pedestrian is outside of a marked crosswalk, drivers must slow down and take any other action necessary to avoid hitting them. The family of any pedestrian that is killed in a car accident may have legal recourse through a wrongful death claim.
