Liability For El Cajon Pedestrian Accidents

Young children and elderly people tend to be the most at risk in pedestrian collisions. According to the Centers for Disease Control, “Adults aged 65 years and older accounted for about 17% of the U.S. population in 2020. However, people ages 65 and older accounted for 20% of all pedestrian deaths in 2020.” There are a number of factors that could contribute to a pedestrian accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. If a driver fails to slow down or take evasive action to avoid hitting a pedestrian, this could form the basis of a negligence claim. Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
