Liability For Koreatown Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the CDC, “One in six people who died in crashes in 2020 were pedestrians. There were also an estimated 104,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2020.” There are a number of factors that could contribute to any pedestrian accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Many collisions are due to drivers that are speeding. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. Drivers that flee the scene of a collision could face criminal and civil liability for their actions. There are a number of steps that should be taken after any hit-and-run collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Fragments of the fleeing vehicle should be examined.
  • An investigation should be conducted.

The family of any person that is killed in a collision may be able to seek some measure of justice through a civil claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, it is common for drivers to deny liability if they hit a pedestrian. This is why it is so important that all evidence is preserved after a crash.
