Liability In Huntington Beach Car Accidents

Car accidents are one of the leading causes of serious injury and death for adolescents in the United States. According to the Centers for Disease Control, in 2019 alone almost 2,400 teens in the United States were killed and another 258,000 were treated in emergency departments for injuries in motor vehicle accidents. The risk for a crash was especially high in the first months after a teen gets their driver’s license. There are a number of factors that could potentially contribute to a serious car accident.

  • Nighttime driving is riskier than daytime driving for all ages.
  • Driver fatigue can be just as dangerous as driver intoxication.
  • Seat belt use can cut the number of fatal collisions in half.
  • Prescription medications can negatively impact drivers in unexpected ways.

All drivers have a legal obligation to exercise due care in order to avoid causing accidents. This is especially true for commercial drivers that work for the city. Many collisions are caused by drivers than make dangerous turns. According to California Vehicle Code 22107, no person shall turn a vehicle left or right upon a roadway until such a movement can be made with reasonable safety. If a driver turns into the path of another vehicle, they will typically be held at fault in the event of a collision.

When the driver of a car is working at the time of a collision, their employer could potentially be liable for the crash. Generally speaking, employers are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a city truck driver may have been delivering packages at the time of a crash. Or they may have been performing police work. To determine whether an employee was working within the scope of their duties, courts may consider many factors including:

  • Whether the employee was on the clock.
  • Whether the employee’s action were similar to their job duties.
  • The foreseeability of the employee’s conduct.
  • The employee’s intent.
  • The amount of time the conduct took.

The family of any victim that died in a car accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. In certain circumstances, a victim’s next of kin may also be able to pursue a survival action if a victim survives for some period prior to their death. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
