Liability For Anaheim Amazon Truck Accidents

Amazon is one of the largest online retailers in the world. They are well known for their speedy deliveries of all sorts of products. But this convenience has come at a high cost. According to Buzzfeed News, “drivers delivering Amazon packages had been involved in more than 60 crashes that led to serious injuries, including 10 deaths.” Amazon drivers are expected to complete nearly all of their deliveries on time. If they fail to do this, it could put their job in jeopardy. There are a number of steps that Amazon truck drivers should take in order to avoid collisions.

  • All drivers should be well rested before they head out on the road.
  • All drivers should abstain from alcohol and other intoxicating substances.
  • All drivers should check their blind spots before making turns.

Amazon truck drivers are expected to exercise due care and do everything in their power to avoid collisions. Many collisions are due to delivery drivers that make dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to make a left turn must first yield the right of way to any vehicle that is close enough so as to pose a hazard. If a driver made an abrupt turn in front of another vehicle, this could form the basis of a negligence claim.

If an Amazon delivery truck driver was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actins of their employees – insofar as those employees were working within the course and scope of their job duties. However, Amazon will often try to avoid liability for crashes by hiring their drivers as “independent contractors.” There are a number of steps that should be taken after any collision.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.

The family of any person that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral costs. Potential beneficiaries will typically include a victim’s spouse and children. Sadly, delivery companies will often do everything in their power to avoid liability for any crash. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
