Liability For Denver DUI Car Accidents

Driver intoxication is one of the leading causes of traffic fatalities in the United States. According to the NHTSA, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 45 minutes. In 2020, 11,654 people died in alcohol-impaired driving traffic deaths — a 14% increase from 2019.” There are many substances besides alcohol that could potentially impair a driver.

  • Benzodiazepines
  • Prescription drugs
  • Over-the-counter medications
  • Sleep aids

It is illegal to operate a motor vehicle under the influence of alcohol or drugs in Colorado. No person shall operate a car with a blood alcohol concentration (BAC) of 0.08% or higher. Commercial drivers are held to an even higher standard. Commercial drivers must not operate a motor vehicle with a BAC of 0.04% or higher.

Both Uber and Lyft offer very extensive insurance policies if a passenger or driver is injured in a car accident. However, the Uber or Lyft driver must have been transporting a passenger or on their way to pickup a passenger. It is extremely important that all evidence is properly preserved after any accident.

  • Surveillance footage of the accident should be sought.
  • Medical records should be preserved.
  • Any driver suspected of DUI should have a blood sample taken.

The family of any person that is killed in a car accident with a drunk driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, drivers will often do everything in their power to avoid responsibility if they cause an accident while intoxicated.
