Liability For Beaumont Box Truck Accidents

Commercial trucks make up a relatively small number of the total percentage of vehicles on the road. However, they are involved in a disproportionate number of fatal collisions. According to the IIHS, “A total of 4,014 people died in large truck crashes in 2020. Fifteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 16 percent were pedestrians, bicyclists or motorcyclists.” There are a number of common causes of truck accidents.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid collisions. No person shall turn a vehicle left or right from their own lane of traffic unless such a movement can be made with reasonable safety. There is a rebuttable presumption of negligence on the part of any driver that crosses into opposing lanes of traffic prior to a crash. If a truck driver was working at the time of a collision, the company that they were working for could be held at fault. In general, companies are liable for the wrongful actions of their employees. There are a number of steps that should be taken after any truck accident.

  • Eye witnesses should be interviewed.
  • The truck’s event data recorder should be examined.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

When a truck driver is negligent and causes a fatal collision, they can be held to account through a civil claim. The family of any person that is killed in a collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. It is very important that evidence is properly preserved after any collision. Evidence is what will ultimately paint a picture of what happened in a crash regardless of what anyone says.
