An accident on the corner of Harvard Avenue and Center Drive culminated in a head injury after a woman was hit by a Lexus. Before she could get to the other side of the street, she was struck by a Lexus ES 350 sedan that was heading west. Authorities have yet to determine the cause of the accident. When a pedestrian knock down accident like the one above occurs, legally speaking the vehicle driver is almost always at fault. This is because pedestrians have the right-of-way, even if they are jaywalking. Of course, certain behaviors may mitigate a driver’ culpability, but the fact remains that vigilant drivers will most likely avoid hitting a pedestrian.
