ATV and side-by-side accidents: what to know
All-terrain vehicles (ATVs) and side-by-sides (UTVs and ROVs) are heavy, powerful and easy to roll. The U.S. Consumer Product Safety Commission (CPSC) received reports of 2,577 deaths linked to off-highway vehicles from 2019 through 2021, and estimates about 100,400 emergency room injuries in 2023 alone (CPSC 2024 report). About three in four of those injuries were to people 16 and older.
Common causes
- Rollovers, often on slopes, in turns or on uneven ground
- Defects, such as brake, throttle, steering or suspension failures, or a roll cage or seat belt that does not protect the rider
- Collisions with cars and trucks on or near paved roads
- Poorly maintained rental or tour vehicles, and guides who take riders onto unsafe terrain
- A careless or impaired driver, when you were the passenger
Who can be responsible
- The manufacturer, for a design or manufacturing defect, or for poor warnings.
- A rental or tour company, for unsafe equipment, poor maintenance, missing safety gear or unsafe routes. A signed waiver does not always end a claim.
- The driver, if you were a passenger or were hit by another rider.
- A landowner, in some cases, for a hidden hazard.
Protect the evidence
Keep the vehicle as it is after the crash. Do not repair it or sell it. If it was a rental, ask in writing that the company keep the vehicle and its maintenance records. Keep the rental contract, the waiver, your receipt and any photos or video from the trip.
What to do now
- Get medical care, and keep every record.
- Photograph the vehicle, the terrain, your helmet and gear, and your injuries.
- Get the names and phone numbers of witnesses and guides.
- Do not give a recorded statement to an insurer or the rental company.
