Do these four things now

The first few days decide a lot of cases. In order:

1
See a doctor todayInjuries can show up days later. If there's a gap in treatment, the insurer will use it against you. No insurance? We'll get you seen.
2
Don't give a recorded statementYou don't have to. Adjusters are trained to get you to say things that lower your claim. Say: "My lawyer will call you."
3
Keep everything. Let us send a preservation letterTruck data and driver logs can be lost. Keep photos, the police report number and the names of witnesses. We ask the company in writing to keep its records.
4
Don't sign anything. Call us.Early release forms and medical authorizations are written to limit what they owe you. A ten-minute call costs nothing and tells you where you stand.

Orange County truck accident questions we get every day

Straight answers. No fine print.

Who is responsible, the driver or the company?
Often more than one: the driver, the trucking company, the trailer owner, or a maintenance or loading company. We look at all of them.
What if I was partly at fault?
California can reduce compensation by your share of responsibility for the harm. Being partly at fault does not automatically end a negligence claim. We review the evidence before accepting an insurer's account of what happened.
How much do you charge?
Nothing up front. We only get paid if you do. Our fee is a percentage of the money we get for you. You see it and sign it before we start. If we don't win, you owe nothing, not even case costs.

Truck accidents in Orange County: what to know

In 2024, 5,340 people were killed and an estimated 161,201 were injured in crashes involving large trucks, according to the National Highway Traffic Safety Administration. A loaded truck can weigh 20 to 30 times as much as a car. The injuries are often severe.

In Orange County, many truck crashes happen on the I-5, I-405, SR-91 and SR-57, where freight from the ports and the Inland Empire mixes with heavy commuter traffic, and in business parks where delivery trucks back up and turn.

Why truck cases are different

  • More than one company can be responsible. The driver, the trucking company, the company that loaded the cargo, and the company that maintained the truck can all share fault.
  • Federal safety rules apply. Interstate truck drivers generally may drive no more than 11 hours after 10 hours off duty, and must take a 30-minute break after 8 hours of driving (FMCSA). Breaking these rules can prove fault.
  • More insurance. Interstate for-hire freight carriers must carry at least $750,000 in liability coverage (49 CFR 387.9), much more than a passenger car.
  • The evidence is in the company's hands. Electronic logs, engine data, dashcam video, maintenance records and the driver's file. Much of it can be overwritten or discarded. A lawyer should send a preservation letter right away.

California rules

California reduces your compensation by your share of the blame but does not take it away. Claims against a government agency can have deadlines measured in months. Call early.

What to do now

  1. Get medical care, and keep going to follow-up visits.
  2. Do not give a recorded statement to the other side's insurer.
  3. Save photos, witness names and the police or incident report number.
  4. Ask nearby businesses and homes to save video right away. See how long camera footage is kept.
  5. Do not talk to the trucking company or its insurer.
  6. Call us. The consultation is free, and there is no fee or cost unless we recover money for you.
