Liability For Deerfield Beach Scooter Accidents

Motorized and non-motorized scooters have become much more popular in recent years with the rise of companies like Lime and Bird. This has coincided with a sharp rise in the number of scooter collisions. According to the United States Consumer Product Safety Commission, injuries involving e-scooters have jumped 70% in the last four years. There were over 190,000 emergency room visits involving micro-mobility products  from 2017 to 2020. There are a number of steps that drivers should take in order to avoid hitting scooter riders.

  • Drivers should check their blind spots before making turns.
  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should use their turn signals to let other drivers and pedestrians know their intentions.

Pursuant to Florida Vehicle Code 316.130, “every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian or any person propelling a human-powered vehicle and give warning when necessary and exercise proper precaution upon observing any child or any obviously confused or incapacitated person.” When a driver fails to slow down to avoid hitting a scooter rider, this could form the basis of a negligence claim.

Pickup trucks are often used for commercial purposes. If a pickup truck driver was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actions of their employees working within the course and scope of their job duties. For example, a pickup truck driver may have been transporting construction materials when they crashed. Victims of scooter accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Florida is a no-fault state when it comes to car accidents. However, any person that is catastrophically injured due to the negligent actions of a driver may be able to seek some measure of justice through a civil claim. Damages in a civil claim can help cover many of the expenses that can come with a serious accident.
