Truck accidents in San Francisco: what to know

Big rigs, delivery trucks and construction trucks share US-101, I-80, I-280 and the Bay Bridge approaches with commuters every day. A loaded tractor-trailer can weigh up to 80,000 pounds, so a crash with a car often causes catastrophic injuries.

Why truck cases are different

  • More than one company can be responsible. The driver, the trucking company, the company that loaded the cargo, and the company that maintained the truck can all share fault.
  • Federal safety rules apply. Interstate truck drivers generally may drive no more than 11 hours after 10 hours off duty, and must take a 30-minute break after 8 hours of driving (FMCSA). Breaking these rules can prove fault.
  • More insurance. Interstate for-hire freight carriers must carry at least $750,000 in liability coverage (49 CFR 387.9), much more than a passenger car.
  • The evidence is in the company's hands. Electronic logs, engine data, dashcam video, maintenance records and the driver's file. Much of it can be overwritten or discarded. A lawyer should send a preservation letter right away.

California rules that shape your case

  • Partly at fault? You can still recover. California reduces your compensation by your share of the blame, but does not take it away.
  • Deadlines vary. How long you have depends on the type of case and who is responsible. Claims against a government agency, such as Muni (SFMTA), the City and County of San Francisco or Caltrans, can have deadlines measured in months. Call early.
