Massachusetts requires motorcycle riders and passengers to wear a helmet. If you were not wearing one, the effect on an injury claim depends on the facts, including whether that affected your injuries. The other driver's fault for the crash is a separate question. We can review the collision and the available evidence.
What if I was partly at fault?
In Massachusetts, you cannot recover if your share of fault is greater than the combined fault of those you claim against. Otherwise, compensation is reduced by your share of fault. An insurer's claim about your share does not decide it. We review the evidence and the law that applies to your claim.

Motorcycle accidents in Boston: what to know

Riders in Boston share I-93, the Mass Pike (I-90), Route 1 and Storrow Drive and busy surface streets with drivers who often do not see them. Even at low speed, a rider has no protection, and injuries are often serious.

How these crashes happen

  • A car turns left across the rider's path
  • A driver changes lanes without checking the blind spot
  • A car door opens into the rider's path
  • Rear-end crashes in stop-and-go traffic
  • Potholes, gravel and uneven pavement

Insurers often assume the rider was speeding or careless. Bias against riders is real, so the evidence matters: video, skid marks, the damage to both vehicles and witness statements.

Massachusetts rules that shape your case

  • No-fault first. Personal injury protection (PIP) from a car policy usually pays first, up to $8,000, for medical bills and lost pay.
  • Pain and suffering. A claim against the at-fault driver for pain and suffering is generally allowed if your reasonable medical costs are more than $2,000, or for serious injuries such as a fracture.
  • Helmets. Massachusetts requires every rider and passenger to wear a helmet. If you were not wearing one, the effect on your claim depends on the facts.
  • Lane splitting is not allowed. Massachusetts law does not allow riding between lanes of traffic. Insurers look for this first. The evidence decides what really happened.
  • Shared fault. Massachusetts reduces your compensation by your share of the blame. If your share is greater than the share of the people you are suing, you recover nothing.
  • Deadlines vary. How long you have depends on the type of case and who is responsible. Claims against a government agency, such as the MBTA, the City of Boston or MassDOT, can have deadlines measured in months. Claims against a city or the Commonwealth have special notice rules. Call early.
