Pedestrian accidents in Chicago: what to know

People on foot have no protection in a crash. In Chicago, many serious pedestrian injuries happen at intersections, on wide and fast streets, and near freeway ramps, often at night or when a driver turns without looking.

Illinois rules that shape your case

  • Drivers must stop. Illinois drivers must stop for a pedestrian in a crosswalk, not just slow down (625 ILCS 5/11-1002).
  • Shared fault. Illinois reduces your compensation by your share of the blame. If your share is more than 50%, you recover nothing. How fault is assigned matters, and that is our fight.
  • Your own insurance can help. If the driver fled or has little insurance, your own uninsured and underinsured motorist coverage may pay, even though you were on foot.
  • Deadlines vary. How long you have depends on the type of case and who is responsible. Claims against a public body, such as the CTA or the City of Chicago, can have shorter or special deadlines. Call early.
