Man Critically Injured In Miami-Dade Semi-Truck Accident on Interstate 95

MIAMI-DADE, FLORIDA (March 8, 2023) – A male pedestrian was critically injured in a Miami-Dade County semi-truck accident as he was crossing Interstate 95.

Miami-Dade officials are saying that the accident took place around 6:00 a.m. on Tuesday. A male pedestrian was trying to cross the freeway when he was hit by a semi-truck.

Firefighters and paramedics were called to the scene of the collision in order to help the victim. He was taken to Jackson Memorial Hospital’s Ryder Trauma Center with critical injuries.

The semi-truck driver involved in the crash remained at the scene. A full investigation into the crash remains ongoing at this time.

Liability For Miami-Dade Semi-Truck Accidents

Semi-truck drivers are put under an enormous amount of pressure to complete their routes as quickly as possible. According to the FMCSA, “The Large Truck Crash Causation Study (LTCCS) reported that 13 percent of commercial motor vehicle (CMV) drivers were considered to have been fatigued at the time of their crash.” There are several other factors that could contribute to a semi-truck accident.

  • Driver intoxication
  • Poor road conditions
  • Inclement weather
  • Speeding

Commercial truck drivers need to get a commercial driver’s license (CDL) and are held to a high standard in terms of safety. They are expected to do everything that human caution and vigilance can to prevent collisions. Truck drivers must also slow down  to avoid hitting pedestrians, even if they are outside of marked crosswalks. If a truck driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. There are a number of steps that should be taken after any semi-truck accident.

  • The work records of the truck driver should be examined.
  • Surveillance footage should be reviewed.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured due to the negligence of a semi-truck driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
