Woman Injured In Fresno Truck Accident By Olive Avenue and Peach Avenue

FRESNO, CALIFORNIA (November 16, 2022) – A woman was hospitalized after a Fresno collision with a truck by Olive Avenue and Peach Avenue.

Fresno County officials are saying that the accident took place around 7:30 p.m. on Friday. A woman was crossing the roadway outside of a marked crosswalk when she was hit by a truck.

A full investigation into the crash on Olive Avenue remains ongoing at this time.

Liability For Fresno Truck Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the IIHS, “Pedestrian motor vehicle crash deaths have increased 59 percent since reaching their low point in 2009 and account for 17 percent of crash fatalities. The rates of pedestrian deaths in motor vehicle crashes per 100,000 people are highest for people ages 20-69.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should be well rested before they head out onto the road.
  • Drivers should scan the road ahead of them for hazards.
  • Drivers should slow down during periods of low visibility.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle approaching a pedestrian in the roadway shall reduce their speed and take any other action necessary to safeguard the safety of the pedestrian. This is true even if a pedestrian is outside of a crosswalk and in the middle of the road. If a driver failed to reduce their speed and hit a pedestrian, this could form the basis of a negligence claim.

Trucks are often used for commercial purposes. If a truck driver was working at the time of a crash, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering materials when they crashed. Victims of pedestrian accidents often suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Even after the physical injuries of a crash have healed, many accident victims are left with long term psychological injuries. Any person that is injured due to the negligence of a truck driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
