Liability In San Francisco Bus Accidents

Buses are one of the safest forms of transportation for passengers. But they can be particularly dangerous to pedestrians and those in smaller vehicles. Among other things, buses have a wide turning radius and a high center of gravity making underride collisions more likely. There are a number of factors that could potentially contribute to a San Francisco bus accident.

  • Speeding contributes to over 1/3 of all fatal collisions.
  • San Francisco has a number of very busy roads, particularly near downtown.
  • Bus drivers can become fatigued and make unsafe driving maneuvers.

Bus companies are considered common carriers and are held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” If a bus driver is negligent and contributes to an accident in any way, they could be held to account through a civil claim.

Many car accidents will have multiple liable parties. Many accidents involve drivers that are speeding. According to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than what would be safe or reasonable given the prevailing conditions of the roadway. If a person was speeding and hits another vehicle, they could be held at fault for the crash. There are a number of steps that should be taken after any Marina District bus accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage of the accident should be reviewed.
  • A thorough, independent investigation should be conducted.

The FMCSA requires buses that can carry 16 or more people to have at least $5,000,000 worth of liability coverage. Any person that is injured in a San Francisco bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
