Liability For Oakland Hit-And-Run Collisions

Far too many pedestrians are killed or seriously injured every year. According to the AAA Foundation for Traffic Safety, “The current analysis found that both the rates of hit-and-run crashes and fatalities are increasing. There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds.” There are a number of factors that could contribute to a pedestrian collision.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. The company that a pickup truck driver worked for could also be held at fault for a collision. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It can be hard to know where to begin after any pedestrian accident. Victims of car accidents may not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that come with serious injuries. It is important that all evidence is preserved after any collision.
