Mark O'Leary Killed In San Diego on Garnet Avenue by Morrell Street

SAN DIEGO, CALIFORNIA (November 30, 2022) – A motorcyclist identified as Mark O’Leary has tragically died in a San Diego car accident with a pickup truck on Morrell Street.

San Diego County officials are saying that the accident took place shortly after noon on November 18. Mark O’Leary was riding a motorcycle down the roadway when a pickup truck pulled directly in front of him.

Firefighters and paramedics were called to the scene of the collision in order to help the victim. Mark O’Leary was transported to a local emergency department with critical injuries.

Despite the best efforts of medical staff, he later died at the hospital. A full investigation remains ongoing at this time.

Liability For San Diego Motorcycle Accidents

Far too many motorcyclists are killed in San Diego County every year. According to the San Diego Reader,  “In 2016, the San Diego Medical Examiner reported 63 motorcyclists died […]. Pursuant to California Vehicle Code 22450, the driver of any vehicle approaching a stop sign shall stop at the limit line before entering the crosswalk. There is a rebuttable presumption of negligence on the part of any person that goes into the path of a motorcyclist.

A city or municipality could be liable for a collision if it was caused by a dangerous condition in the roadway. According to California Government Code 835, a public entity is liable for an accident caused by a dangerous condition with a roadway provided that the dangerous condition created a reasonably foreseeable risk of injury. Victims of motorcycle accidents tend to suffer very serious injuries including:

  • Head injuries
  • Lacerations
  • Spinal cord injuries
