Elderly Pedestrian Killed In Mira Mesa Pickup Truck Accident By Polaris Drive and Capricorn Way

MIRA MESA, CALIFORNIA (November 14, 2022) – An elderly pedestrian died in a Mira Mesa car accident with a pickup truck by Polaris Drive and Capricorn Way.

San Diego County police officials are saying that the accident took place around 7:30 a.m. on Friday. A pedestrian was crossing the roadway when they were hit by a Toyota Tacoma pickup truck.

The pickup truck driver just went past a stop sign before hitting the victim. He said that he could not see the pedestrian due to the glare of the morning sun.

First responders were called to the scene of the collision in order to help the pedestrian. Despite life-saving measures, the man died at the scene.

A full investigation remains ongoing at this time.

Liability For Mira Mesa Pedestrian Accidents

San Diego has one of the highest instances of pedestrian accidents across California. According to the San Diego City Government, “On average, 1,000 pedestrians and bicyclists are hit and seriously injured each year in San Diego. Residents living in neighborhoods where more people walk – Downtown, Southeastern and City Heights – are hardest hit. They are 10x more likely to be hit by a car.” There are a number of factors that could contribute to a pedestrian accident.

  • Speeding
  • Inclement weather
  • Distracted driving
  • Poor road conditions

All drivers have a legal obligation to exercise due care to avoid hitting pedestrians, pursuant to California Vehicle Code 21950. In general, being temporarily blinded by the sun does not excuse a person from liability for hitting a pedestrian. When a person drives, they are supposed to prepare for potential hazards that occur – including the glare of the sun. A driver may need to slow down so that they can react safely and appropriately to the glare of the sun.

Pickup trucks are often used for commercial purposes. If the driver of a pickup truck was working at the time of a collision, the company that they were working for could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

The family of any pedestrian killed in a car accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. It is extremely important that evidence is properly preserved after any collision. Evidence is essential for determining liability after a crash.
