Liability In Apple Valley Dog Attacks

Dog attacks are one of the most common causes of injury in the United States. According to the American Veterinary Medical Association, “More than 4.5 million people are bitten by dogs each year in the United States, and more than 800,000 receive medical attention for dog bites, according to the U.S. Centers for Disease Control (CDC). At least half of those bitten are children.” There are a number of risky situations that people should avoid when dealing with a new dog.

  • Avoid touching a dog that is sick or injured.
  • Avoid touching a dog that is eating.
  • Avoid touching a dog that is barking.
  • Avoid touching a dog that is with her puppies.

California is a strict liability state when it comes to dog attacks. Pursuant to California Civil Code 3342, the owner of a dog is liable for damages suffered by a person bitten by the dog while they are in a private or public place. This includes the home of the owner of a dog. It does not matter if the dog never attacked anyone previously. Depending on the facts of any case, liability for a dog attack could extend beyond a dog owner.

If the owner of a dog was working a the time of an attack, the company that they were working for could face civil liability. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees are working within the course and scope of their job duties. Courts across California have consistently held that those who are charged with the care of children must adequately supervise them. They must follow  all rules and regulations necessary for their protection. Victims of dog attacks tend to suffer very serious and costly injuries including:

  • Broken bones
  • Lacerations
  • Infections
  • Organ damage
  • PTSD

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, dog owners will often fight extremely hard to deny responsibility for any attack. It is common for them to blame the victim.
