Liability In Coalinga Hit-And-Run Car Accidents

Thousands of people are killed or seriously injured every year in hit-and-run car accidents. According to the AAA, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” There are a number of factors that could potentially contribute to a Coalinga hit-and-run car accident.

  • Drunk driving
  • Speeding
  • Inclement weather
  • Driver fatigue

It is illegal to flee the scene of any collision that results in bodily injury or death. Any driver that is involved in an injury collision must remain at the scene of the collision until police arrive. If a driver flees the scene of a collision, they could face criminal as well as civil liability. There are a number of steps that should be taken after any hit-and-run collision.

  • Fragments of the fleeing vehicle should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a Coalinga hit-and-run accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often fight extremely hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
