Liability For Chandler Semi-Truck Accidents

Semi-trucks are some of the most dangerous vehicles on the roadway. According to the National Safety Council, “In 2020, 4,842 large trucks were involved in a fatal crash, a 4% decrease from 2019 but still a 33% increase since 2011. The involvement rate per 100 million large-truck miles traveled is down 5% from 2019, but up 18% since 2011.” There are many steps that truck drivers should take to prevent collisions.

  • Truck drivers should be well rested before they head out onto the road.
  • Truck drivers should use commercial GPS for their routes.
  • Truck drivers should avoid using their computer or cellphones while driving.

Fatigue, in particular, is one of the most common causes of truck accidents. The Centers for Disease Control estimates that staying awake for only 18 hours can reduce a person’s ability to drive safely equal to driving with a blood alcohol concentration of 0.05%. It is common for truck companies to push their drivers to complete routes on an unrealistic time schedule. This is the route cause of many accidents.

All truck drivers have a legal obligation to exercise due care to avoid collisions. Pursuant to Arizona Revised Statute 28-701, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of travel.

If a truck driver was working at the time of a collision, their employer could be vicariously liable. Generally speaking, employers are liable for the wrongful actions of their employees who were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they crashed. There are a number of steps that should be taken after any semi-truck accident.

  • Surveillance footage should be sought.
  • The truck’s event data recorder EDR should be examined.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.

It is extremely important that evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability for any crash. The family of any person that is killed due to the negligent actions of another driver may have legal recourse through a wrongful death claim. Unfortunately, it is very common for truck companies to deny liability for any collision involving their driver.
