Liability In Huntington Beach Inmate Deaths

Far too many inmates die in custody every year. According to the Bureau of Justice Statistics, “In 2019, a total of 3,853 prisoners died in state prisons or private prison facilities under a state contract, a decrease of 284 deaths from 2018. The number of federal prisoners who died in the custody of a facility operated by the Federal Bureau of Prisons (BOP) increased from 378 in 2018 to 381 in 2019.” There are a number of steps that jails should take in order to prevent inmate deaths.

  • Inmate should receive healthcare for all of their medical conditions.
  • Inmates should also receive a psychological screening before being admitted.
  • Inmates should receive periodic safety checks to make sure they are ok.
  • Jail staff should be properly trained to recognize when an inmate is in medical distress.

All inmates have a constitutional right to receive reasonably adequate healthcare. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. Deliberate indifference could come in many forms. For example, an inmate suspected of being at risk for an overdose may not have gotten prompt medical care. There are a number of steps that should be taken after any inmate death.

  • An independent autopsy should be performed.
  • Jail records should be reviewed.
  • A thorough, independent investigation should be conducted.

The family of any inmate that died in custody may have legal recourse through a wrongful death claim. Damages can help cover many of the unexpected expenses that can come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations to keep in mind. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
